1. Services
The Branding Book provides branding and design services, including but not limited to brand identities, website design, marketing materials, and social media content. The specific scope of services will be detailed in the project proposal or contract.
2. General Conditions

Applicability: These Terms and Conditions apply to all services provided by The Branding Book unless otherwise agreed in writing.

Changes: We reserve the right to update these Terms and Conditions without prior notice. The latest version will be available on our website.
3. Project Scope & Deliverables

Initial Consultation: We offer a free initial consultation to discuss your project requirements.

Brand Audit :

Visual Brief: A detailed Visual Brief will be developed to define project scope. If no delivery date is set, payments are required as outlined in Section 5.

Revisions: We do not limit the number of revisions under the original Visual Brief. Additional revisions or work outside the brief will be charged at $120 per hour.
4. Complimentary Brand Audit Consultation

Eligibility: The free 30-minute brand audit consultation (the "Consultation") is available to new and potential clients of The Branding Book (the "Company"). The Consultation is intended to provide an overview of your brand and discuss how our services can meet your needs.

Booking: To schedule a Consultation, you must contact us through our website form. Availability is subject to our schedule and may vary.

Duration: The Consultation will last up to 30 minutes. Any time spent beyond this period will be subject to our standard consultation rates.

Scope: The Consultation includes an overview of your current brand, a discussion of potential branding needs, and a brief explanation of how our services might address those needs. It does not include detailed strategic planning or design work.

Free of Charge: The Consultation is provided free of charge and does not obligate you to engage with The Branding Book for any further services.

Proposal : Following the Consultation, if you choose to proceed with our services, a formal proposal will be provided outlining the scope of work and associated costs.

Privacy: Any information shared during the Consultation will be treated as confidential and used solely for the purpose of discussing potential branding solutions. We adhere to our Privacy Policy in handling any personal or business information you provide during the Consultation.

No Guarantees: The Consultation does not guarantee any specific outcomes or results from our services. It is intended to provide an initial assessment and discuss potential next steps.

Company Cancellation: The Branding Book reserves the right to cancel or reschedule the Consultation due to unforeseen circumstances. In such cases, we will make all efforts to provide an alternative appointment.
5. Quotations

Estimates: Quotations are based on the Visual Brief and expected time investment. Quotes may change if additional work is required.

Delivery Dates: All delivery dates are estimates and not guaranteed.
6. Payment Terms

Deposits: We require a 50% deposit before commencing work. An invoice will be issued, and payment must be made to confirm acceptance of these Terms and Conditions. No work will commence until a 50% deposit is secured.

Invoicing: Remaining costs will be invoiced prior to final delivery of services. We may withhold services until payment is received.

Late Payments: Payments are due within 7 days of invoicing. We may charge fees for overdue accounts and delete websites with accounts outstanding for more than 90 days.

Payment Plans: Payment plans may be arranged at our discretion and must be agreed upon in writing.
7. Cancellation & Termination

Cancellation: If you cancel a project, we will invoice for work completed up to the cancellation date. Deposits may be retained or refunded as appropriate.

Project Completion: If no response is received within 30 days of providing a concept, the project will be deemed complete, and we will invoice for the total project amount.
8. Approving Designs

Client Responsibility: You are responsible for approving all proofs, including design, spelling, and quantity. The final accepted proof will be used for printing or web development. No reprints or changes will be made at our expense after approval.
9. Limitation of Liability

Exclusion: We are not liable for any indirect or consequential damages related to our services. Your use of our services is at your own risk.

Indemnity: You agree to indemnify The Branding Book against any claims arising from your use of our services or content.
10. Submission of Client Artwork
Responsibility: If you submit your own artwork, you are responsible for ensuring it is print-ready and complies with copyright laws. We are not liable for errors in submitted files.
11 Copyright & Ownership
Ownership: Copyright for all concepts and draft artwork remains with The Branding Book until payment is made in full. Upon payment, copyright ownership transfers to you. We retain the right to use work for our portfolio and marketing.
12. Website Design

Credit: We add a small credit to your website in the form of a small line in the footer of the site. We also use your website for our promotional purposes unless otherwise agreed.

Post-Completion: Minor changes can be requested within 14 days of review. Additional changes may incur charges.
13. SEO & Technological Advancements

SEO: We build websites according to current SEO trends, but cannot guarantee search engine rankings.

Technology: We are not liable for issues arising from technological advancements or software obsolescence.
14. CMS & Content Management Systems

Responsibility: You are responsible for changes made to your CMS by yourself or third parties. We are not liable for misuse or content posted on your website.
15. Force Majeure

Liability: We are not liable for delays or failures in service due to circumstances beyond our control, including natural disasters, strikes, and other events.
